One implication of the rejection of justice fetishism is that from the fact that capitalism is inherently and irredeemably unjust\, it does not follow that it is unjustifiable or ought to be abolished.\n\n\n\n\n\n\n[/vc_column_text][/vc_column][/vc_row]

In particular\, her scholarship to date has focused on exploring the implications of this intersection in the public corporation context. Saura’s articles have appeared in the Northwestern Law Review\, the Texas Law Review\, the Washington University Law Review\, the Journal of Corporate Law\, and Social Philosophy and Policy\, among other outlets. Existing accounts defend market activism as liberty (common good anarchists) or reject it as undemocratic (proceduralists)\, but each contradicts the widely accepted Dual Commitment of just societies to both markets and democracy. This essay develops a rights-based analysis that avoids this contradiction by clarifying how our market and democratic rights can be made compossible under the Dual Commitment\, thereby precisifying when market activism is morally permissible. Ultimately\, we connect market activism to defensive ethics\, arguing that when firms engage in unjust takings—exploiting market failures and local justice deficits to harm citizens—market activism may be justified as a form of defensive harm. As such\, it must meet the conditions of liability\, necessity\, and proportionality that ground permissible defense. We conclude that not all forms of market activism are alike\, nor are they equally permissible. \nAuthors: Saura Masconale* and Simone M. That’s where psychology comes in\, examining the emotional and cognitive factors behind generosity. I’ll discuss experiments that test how ownership perceptions affect giving. In one version\, the dictator earns and controls the endowment (Earn-Give). In another version\, the recipient earns it (Earn-Take). Previous research by List (2007) found that recipients fare better when the experimenter bestows the dictator with an endowment rather than when the dictator earns it\, suggesting that earned ownership reduces generosity. Similarly\, studies by Korenok\, Millner\, and Razzolini (2011\, 2013) show that recipients fare better in a taking frame rather than a giving frame\, reinforcing the idea that perceived ownership influences giving behavior. Using questionnaires to measure affect and ownership\, we find that giving is highest when dictators feel the least sense of ownership over the money. These findings offer practical insights into how philanthropic organizations might encourage greater generosity. \n[/vc_column_text][/vc_column][/vc_row]

Entrepreneurial activity’s drive typically is assumed to be the profit motive. That is\, to discover new ways to meet consumer demand is to discover new ways to make money. The idea of social entrepreneurship is that some other motive is sometimes driving entrepreneurship\, such as a desire to make the world a better place. William Baumol’s classic 1990 paper\, “Entrepreneurship: Productive\, Unproductive\, and Destructive” offers an interesting hypothesis: namely\, “While the total supply of entrepreneurs varies among societies\, the productive contribution of the society’s entrepreneurial activities varies much more because of their allocation between productive activities such as innovation and largely unproductive activities such as rent seeking or organized crime. This allocation is heavily influenced by the relative payoffs society offers to such activities. This implies that policy can influence the allocation of entrepreneurship more effectively than it can influence its supply” (JPE\, 98 [1990]: 893-921\, at 893). \nKeeping Baumol’s hypothesis in mind\, my questions are: what is social entrepreneurship? What distinguishes social entrepreneurship from plain entrepreneurship? And\, if entrepreneurship can come in productive\, unproductive\, and destructive forms\, is that likewise true when it comes to more specifically social entrepreneurship? If so\, what should we do about it? What are the implications for corporate policy and regulatory policy? \n[/vc_column_text][/vc_column_inner][/vc_row_inner][/vc_column][/vc_row]

This assumption—given that “ought” implies “can”—rests on another\, namely\, that the state can be an effective agent for justice. To justify this assumption\, it is necessary to address Marx’s view that\, in capitalism\, state behavior is disproportionately influenced by the wealthy\, who use it to pursue interests that are in opposition to the demands of justice. We identify three mechanisms that can\, in combination\, mitigate the tendency of the state in capitalism to hinder progress toward justice\, but we argue that the extent of the state’s ability to advance justice is presently unknowable.[/vc_column_text][/vc_column_inner][/vc_row_inner][/vc_column][/vc_row]

Formalism is widely viewed as fundamentally flawed: the main argument against legal formalism is that applying the law essentially involves exception-making and exception-making in applying the law requires appeals to extra-legal resources. In this paper we present this argument precisely and show that it relies on assuming that laws are monotonic in two specific ways and present a nonmonotonic formal framework for a family of legal formalisms.[/vc_column_text][/vc_column_inner][/vc_row_inner][/vc_column][/vc_row]

Her research interests include democratic theory\, representation (especially the representation of historically disadvantaged groups)\, feminist theory and human rights. She is most interested in exploring how democratic citizens should evaluate those who hold and exercise power over vulnerable and marginalized groups. Suzanne Dovi earned her Ph.d from Princeton University but she also has a MA from Georgetown University and a M. Litt. from Trinity College\, Dublin. Her work has appeared in American Political Science Review\, Journal of Politics\, Political Theory\, Gender & Politics\, Contemporary Political Theory\, Constellations\, and Polity. Her book\, The Good Representative\, was published by Blackwell in 2008 and was the subject of a special issue in PS: Political Science & Politics. She is currently working on another book project about how representation can have undemocratic and inegalitarian effects. This book is entitled Toxic Representation.[/vc_column_text][/vc_column_inner][vc_column_inner column_padding=”padding-3-percent” column_padding_tablet=”inherit” column_padding_phone=”inherit” column_padding_position=”top-bottom” column_element_direction_desktop=”default” column_element_spacing=”default” desktop_text_alignment=”default” tablet_text_alignment=”default” phone_text_alignment=”default” background_color_opacity=”1″ background_hover_color_opacity=”1″ column_backdrop_filter=”none” column_shadow=”none” column_border_radius=”none” column_link_target=”_self” overflow=”visible” gradient_direction=”left_to_right” overlay_strength=”0.3″ width=”1/2″ tablet_width_inherit=”default” animation_type=”default” enable_animation=”true” animation=”fade-in-from-bottom” animation_easing=”default” bg_image_animation=”none” border_type=”simple” column_border_width=”none” column_border_style=”solid” delay=”100″][vc_column_text css=”.vc_custom_1741123265654{padding-right: 10% !important;}” text_direction=”default”]Abstract: \nPresident Trump’s judicial appointments were marked by their unprecedented levels of homogeneity: two-thirds of Trump’s judicial appointments to the federal bench were white men; virtually all appointees were members of the Federalist Society; and all of his three US Supreme Court nominations were arguably Catholic. \nDoes justice require a diverse judiciary? I think so\, and in this talk I posit two concrete recommendations for understanding the relationship between justice and a diverse judiciary. \nFirst\, I argue that descriptive representation is desirable when it is necessary to redistribute who receives a “justice dividend” in contexts of systemic structural oppression. In other words\, the continued and persistent nature of the institutional legacies from past forms of discrimination produces the need for descriptive representation. \nSecond\, I argue that we need to pluralize the conceptions\, and therefore the standards\, of justice used to evaluate judicial diversity. Instead of ignoring disagreements about the meaning of justice\, I propose using those different understandings to generate different standards of justice. Each way of understanding justice offers a different way of measuring the justice dividend that reflects substantive worries arising from oppressive structural relations. I propose three ideal standards of justice: justice as anti-monopoly\, justice as reparation\, and justice as non-partisanship. \n[/vc_column_text][/vc_column_inner][/vc_row_inner][/vc_column][/vc_row]

While strides have been made toward closing the gap\, women still earn less on average than men\, even after accounting for factors like education\, experience\, and occupation. We will examine how implicit biases\, workplace norms\, and decision-making behaviors contribute to this disparity. By analyzing both employer and employee perspectives\, we reveal how positive intentions\, and behavioral patterns reinforce existing wage inequalities[/vc_column_text][/vc_column_inner][/vc_row_inner][/vc_column][/vc_row]
